Maryland man who was deported must be released: US urged to start process

The Supreme Court has ordered the Trump administration to facilitate the return of Kilmar Abrego Garcia, a Maryland man who was mistakenly deported to El Salvador. Abrego Garcia was deported despite having a protective order against expulsion from the United States, and he was sent to a harsh and dangerous confinement center in El Salvador.

The Trump administration admitted that the deportation was a mistake, attributing it to an administrative error. The case made its way to U.S. District Judge Paula Xinis, who ordered Abrego Garcia’s return to the U.S. by the end of April 7. The Supreme Court intervened, putting Xinis’s order on hold pending further review.

The high court expressed concern about the order’s wording and its impact on foreign affairs, instructing Xinis to clarify her directive to the government. The Justice Department, meanwhile, stressed the exclusive prerogative of the president in conducting foreign affairs.

Abrego Garcia’s attorney applauded the ruling, stating that the rule of law had prevailed and urging the government to act promptly to bring him back to the U.S. Abrego Garcia, who had previously won a court order protecting him from deportation, has maintained that he is not a gang member and was sent to the U.S. by his parents to escape gang pressure in El Salvador.

The case highlights the complexity and potential consequences of administrative errors in the immigration system, as well as the importance of adhering to legal protections for those facing deportation.
