In a recent federal lawsuit, a judge declined to block billionaire Elon Musk and the Department of Government Efficiency (DOGE) from accessing government data systems and participating in worker layoffs. The lawsuit was filed by 14 states questioning Musk’s authority, arguing that actions taken by him at DOGE can only be carried out by a Senate-confirmed official. While the judge found legitimate concerns about Musk’s authority, she did not see enough evidence to justify a temporary restraining order.
The Trump administration has maintained that Musk does not have independent authority and that layoffs are approved by agency heads. Musk’s team has been accessing government computer systems with the approval of President Donald Trump to search for waste, fraud, and abuse. Despite growing legal challenges alleging DOGE’s violations of the law, the judge’s decision allows Musk and DOGE to continue accessing government data systems for the time being.
