Kimberly Diei reaches agreement with University of Tennessee for $250K settlement


Kimberly Diei, a former University of Tennessee pharmacy student, was awarded $250,000 after claiming her First Amendment rights were violated by the college threatening to expel her over a social media post containing lyrics from Cardi B’s song “WAP.” The college found Diei’s posts to be crude, vulgar, and sexual, prompting two investigations and nearly leading to her expulsion. Diei sued her public university for violating her constitutional rights by policing her off-campus expression on social media. The Foundation for Individual Rights and Expression (FIRE) announced the settlement, emphasizing that students have the right to express themselves even if administrators disagree. Diei graduated from UT and is now a practicing pharmacist, planning to use the settlement money to possibly pay off student loans or invest in the stock market. She expressed no shame over her posts and mentioned a desired tropical vacation to celebrate the end of her legal battle. Diei left a message for her haters on social media, thanking them for giving her “250,000 reasons to smile.” She referred media inquiries to FIRE, who did not immediately respond to requests for comment.
