Justice Department seeks Supreme Court’s intervention in EPA and student debt cases


The Trump administration has requested the Supreme Court to put several cases on hold in order to reconsider positions taken by the previous administration on student loan forgiveness and three environmental issues. This could potentially result in the Justice Department ceasing to defend actions taken by the Environmental Protection Agency during the Biden administration in cases concerning emissions limits, ozone pollution reduction plans, and oil refineries’ requests for exemptions. Additionally, the Trump administration seeks to revisit a rule forgiving student debt for borrowers defrauded by colleges, which was struck down by the 5th U.S. Circuit Court of Appeals.

Legal scholar John Shu expects the court to grant the Justice Department’s requests for these cases. The Biden administration also wants to reassess the basis for its policies regarding these issues. It remains unclear if the Trump administration will change the government’s stance on cases that have already been argued but not decided, such as the ban on transgender adolescents accessing puberty blockers and hormone therapy imposed by states like Tennessee.

In the past, the Trump administration made abrupt reversals in four high-profile cases, prompting some speculation about how the Supreme Court would view such changes. Ultimately, the court sided with Trump’s Justice Department in those cases. However, when the Biden administration took office, it reversed its position on the challenge to the Affordable Care Act, resulting in the Supreme Court dismissing the challenge without deciding the underlying constitutional issue.
